Terms of service
1. Definitions
“Company”, “we”, “us” refers to the service provider.
“Customer” refers to the person or entity engaging our services.
“Goods” refers to bicycles, parts, accessories, and related equipment.
2. Ownership
All Goods remain the sole property of the Customer at all times unless otherwise agreed in writing.
3. Risk & Insurance
All Goods are held at the Customer’s sole risk from the time of receipt until return or delivery.
The Customer is solely responsible for ensuring adequate insurance coverage for Goods while in our possession, including but not limited to theft, loss, fire, or accidental damage.
To the maximum extent permitted by law, we accept no liability for loss or theft of Goods, except where such liability cannot be excluded under the Consumer Guarantees Act 1993 or other applicable law.
4. Care, Handling & Limited Liability
We will exercise reasonable skill and care in the handling, servicing, storage, and transport of all Goods.
Where accidental damage occurs as a direct result of our handling or workmanship, we will, at our discretion, either repair or remedy the issue where reasonably practicable.
Our liability is strictly limited to repair or rectification of the affected Goods and does not extend to replacement, depreciation, loss of use, or consequential loss of any kind.
5. Pre-Existing Condition
The Customer acknowledges that Goods may have pre-existing defects, wear, corrosion, or mechanical faults at the time of receipt.
We are not liable for any failure, defect, or damage arising from pre-existing conditions, including but not limited to wear and tear, fatigue, rust, or previous poor repairs.
Where reasonably practicable, we will notify the Customer of significant issues before proceeding with additional work.
6. Authority to Carry Out Additional Work
The Customer authorises us to carry out additional repairs or replacement of parts without further approval where the total additional cost does not exceed $80.00 NZD including GST.
This includes work reasonably required to complete the requested service safely, correctly, or to address issues identified during inspection or repair.
Where additional costs are likely to exceed $80.00, we will attempt to obtain Customer approval before proceeding.
If we are unable to contact the Customer within a reasonable timeframe, work may be paused until approval is received.
The Customer remains responsible for payment of all authorised work carried out under this clause.
7. Appointments, Delivery, Collection & Holding Period
7.1 Booking Rescheduling & Cancellation
Appointments may be rescheduled or cancelled by the Customer with at least 24 hours’ notice prior to the scheduled booking time.
Where less than 24 hours’ notice is provided, we reserve the right to charge a reasonable cancellation, call-out, or lost-time fee to cover time, travel, and scheduling costs incurred.
Failure to attend a scheduled appointment without notice may also incur a reasonable fee.
7.2 Service Delays & Rescheduling by Company
We reserve the right to reschedule, postpone, or delay appointments, collections, deliveries, or services where reasonably necessary due to circumstances outside our control, including but not limited to weather conditions, illness, injury, vehicle issues, supply delays, emergencies, or other unforeseen operational events.
We will make reasonable efforts to notify the Customer as soon as practicable and arrange an alternative time where possible.
To the maximum extent permitted by law, we are not liable for any loss, inconvenience, delay, or consequential damage arising from such rescheduling or delays.
7.3 Return, Delivery & Holding Period
Goods will be returned or delivered upon completion of services.
Where Goods are not immediately collected or delivered, we may hold them for up to 7 days after completion of work.
After this period, we reserve the right to apply reasonable storage and/or handling fees and/or arrange alternative return methods after reasonable attempts to contact the Customer.
8. Payment Terms & Lien
Invoices are issued upon completion of work with a completion date provided.
Payment is due within 1 day of invoice, unless otherwise agreed in writing or stated on the invoice due date.
We reserve the right to retain possession of Goods until full payment is received in cleared funds.
We may exercise a lawful lien over Goods in our possession for unpaid amounts.
Overdue accounts may incur reasonable debt recovery and late payment costs where permitted by law.
9. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss or damage arising from the provision of services.
Nothing in these terms excludes or limits rights under the Consumer Guarantees Act 1993 or any other non-excludable legal rights.
10. Entire Agreement & Acceptance
By engaging our services, the Customer acknowledges that they have read, understood, and agree to these Terms of Trade.
These terms constitute the entire agreement between the parties in relation to the services provided.
The Customer is deemed to have accepted these Terms of Trade upon any of the following:
